How do you generate B2B leads without cold calling?
Two systems, running together. Pages that answer the questions your buyers type, so they arrive already convinced. And a small number of researched emails sent one at a time. In RAIN Group’s 2017 survey of 489 sellers, only 5% rated untargeted mass email very effective, against 31% for personalized email written after research.
We do not do mass mailing. The section below explains why, with the numbers.
Why the old playbook stalls
The call is not the problem. The volume is.
Most companies react to a dead phone by sending more email to more people. That is the move the data argues against.
01
Volume is the weakest lever you have
In RAIN Group’s 2017 survey of 489 sellers, 5% called untargeted mass email very effective. Personalized email written after research scored 31%. Sending six times more of the weak thing does not close the gap.
02
Buyers will read, but they will not pick up
Asked how they prefer to be approached, 80% of the 488 B2B buyers in RAIN Group’s 2017 research named email and 49% named the phone. The channel is not what is broken. What you send down it is.
03
Nobody follows up, so the work evaporates
An enquiry arrives while you are on a shoot. It sits in an inbox. Nothing logs it, nothing reminds anyone, and three weeks later the prospect has hired the company that answered on day two.
How it works
Automate the follow-up. Never automate the personalization.
This is the whole distinction, and it is the one most tools get backwards. A machine is excellent at remembering. It is bad at sounding like it read your prospect’s site.
Be findable first, so the best leads never need an email
The cheapest lead is the one that arrives on its own. Answer pages, clean HTML a crawler can read, and structured data so Google and the AI assistants can quote you. Outbound then becomes the small, deliberate half of the system instead of the whole of it.
Research, then write one message at a time
A short list of companies that actually fit. Ten minutes of reading each one before a word is written. The first paragraph refers to something real about that company. RAIN Group’s 2017 sellers rated automated field personalization, the mail merge that drops a first name and a company name into a template, at 9% very effective, barely above the 5% for no personalization at all. Merge tags are not research.
Let the machine do the remembering
Every enquiry captured in a CRM. A sequence that nudges on day 4 and day 11 and stops dead the second someone replies. A suppression file checked before every send and never emptied. Reporting that ties each lead back to the page or the message that produced it. That is what we automate: the mechanics.
What we will not do: buy a list, scrape addresses, run a blasting tool from your domain, write “Re:” on a first contact, or dress up a template as a personal note. Those are the exact behaviours the FTC’s CAN-SPAM guide treats as aggravated, and they are also what gets a sending domain burned.
Compliance
CAN-SPAM, in plain English.
Cold email to a work address is legal in the United States. The FTC’s CAN-SPAM Act Compliance Guide for Business requires no prior consent and grants no B2B exemption, but every message has to obey the rules, and every non-compliant message counts on its own. The civil penalty in that guide is up to $53,088 per email. Forty bad messages are forty violations.
A real physical address in every message
A street address, a registered USPS post office box, or a mailbox from a commercial mail receiving agency. The FTC guide is clear that an invented or non-existent address is itself a violation. We get yours in place before the first send, and it goes in the footer of every message.
An opt-out that works, honored fast
The FTC guide gives you 10 business days to honor an unsubscribe and requires the mechanism to keep working for at least 30 days after the send. You may not charge for it, ask for anything beyond an email address, or make someone log in. We process stops within 48 hours, because the legal margin is not a target.
Headers and subject lines that tell the truth
From, To, Reply-To and routing data have to identify the real sender, and the subject line has to reflect what is inside. The FTC guide also requires the message to be identifiable as an advertisement. In practice that rules out “Re:” with no prior exchange, “as discussed”, and anything implying a relationship that does not exist.
California is the real exposure
Federal CAN-SPAM can only be enforced by the FTC, state attorneys general and ISPs. California’s Business and Professions Code section 17529.5 survives it and lets the recipient sue directly: $1,000 in statutory damages per email, up to $1,000,000 per incident, cut to $100 per email if you can prove you had reasonable procedures in place. That proof is a document, kept from day one. It is part of what we set up.
Text messages are a different law entirely
SMS is governed by the TCPA, not CAN-SPAM, and the rule is inverted: marketing texts need prior express written consent. Under 47 U.S.C. 227(b)(3) the recipient can sue for $500 per message, or $1,500 if the violation was willful. So SMS is switched on only for contacts with a timestamped opt-in, and we never import a phone list that arrives without one.

Questions
Straight answers.
Do you send mass email campaigns?
No. We do not buy lists, we do not blast, and we do not run a tool that fires thousands of messages from your domain. Messages go out in low volume, one at a time, from a real mailbox belonging to a real person at your company or at ours.
Is cold email legal in the United States?
Yes, if the message follows the rules. According to the FTC’s CAN-SPAM Act Compliance Guide for Business, the law requires no prior consent and grants no B2B exemption, but it does require honest headers, a subject line that matches the content, a valid physical postal address, and a working opt-out honored within 10 business days. Each non-compliant email is a separate violation carrying a civil penalty of up to $53,088.
Can you text my prospects?
Only the ones who opted in, in writing, before the first message. Marketing texts fall under the TCPA, not CAN-SPAM, and the rule is the opposite: 47 U.S.C. 227(b)(3) gives the recipient a private right of action worth $500 per message, or $1,500 if the violation was willful. There is no cold SMS. We will not import a phone list without proof of consent attached to it.
What does the automation actually automate?
The mechanics, never the thinking. Automated: capturing an enquiry, logging it in the CRM, reminding you on day 4 and day 11, stopping every sequence the moment someone replies, suppressing anyone who opted out, and reporting which page produced which lead. Written by a human: the research and the first paragraph of every message.
Who is liable if a message breaks the rules?
Both of us, which is why we are strict about it. The FTC’s CAN-SPAM Act Compliance Guide for Business is explicit that outsourcing does not move responsibility: the company whose product is promoted and the company that pushes send can both be held liable. Our contract says who supplies the postal address, who guarantees where the list came from, and that we can stop a send.
